Envo Service Agreement
This Service Agreement ("Agreement" or "Service Agreement") contains the terms and conditions governing your access to and use of the Site and Services (defined below) we provide and is between us and you or the entity you represent protocol. Before using this website or service, please read this "Service Agreement" carefully. By using the Site, or by clicking the button or checkbox to accept or agree to the terms of service of this Service Agreement (if such option is available), or filling out an order for the Services, or, if earlier, using or otherwise accessing the Services ("Effective Date"), you (1) accept and agree to this Service Agreement and any additional terms, rules and conditions of participation that we publish from time to time, and (2) consent to the collection of , use, disclosure and other processing of information. If you do not agree to this Service Agreement, you may not access or use the Services.
We hereby remind you that before using our Envo mobile application (hereinafter referred to as "Envo" or the "Software", Envo can be downloaded on various mobile application platforms, including but not limited to Google Play Store and Apple App Store), please Carefully read this "Service Agreement" and other documents mentioned in this "Service Agreement", especially the "Disclaimer and Limitation of Liability" clause in this "Service Agreement", to ensure that you fully understand the terms of this "Service Agreement", and Consider the risks of using Envo independently.
1. Confirmation and acceptance of this "Service Agreement"
1. You understand that this "Service Agreement" and related agreements apply to Envo and the decentralized applications ("DApps") independently developed and owned by us on Envo (excluding DApps developed by third parties).
2. When you download the Envo software and create an identity, restore an identity (see below) or import a wallet, it is deemed that you have fully read and accepted all the terms of this "Service Agreement". This "Service Agreement" will take effect immediately and bind both parties force. If you do not agree to the terms of this Agreement, you must stop using Envo immediately. If you have already downloaded Envo, please delete it now.
3. When accessing or using Envo, you agree to:
(1) Accept the latest version of this "Service Agreement" (no change or modification);
(2) in your applicable jurisdiction, you are of legal age to use Envo and can assume binding legal or monetary obligations arising from the use of Envo; and
(3) You are not an Excluded Person (as defined below).
4. This "Service Agreement" can be updated by us at any time. Once the revised "Service Agreement" is published on our website, it will automatically take effect immediately without further notice. If you do not accept the revised terms after we post the revised terms of the agreement, please stop using Envo immediately.
5. For your attention, your use of Envo following any such modifications to these Terms of Service constitutes your acceptance of those modified Terms of Service.
2. 2. Definition
1. China: refers to the People's Republic of China, including (1) Hong Kong Special Administrative Region, (2) Macao Special Administrative Region and (3) Taiwan.
2. Envo: refers to the multi-currency digital wallet developed by us based on distributed ledger technology, including other auxiliary tools developed to facilitate your use of the blockchain system.
3. Excluded persons:
(1) A person other than a natural person who has the legal and intellectual capacity to enter into this Service Agreement; or
(2) Being prohibited, restricted, unauthorized or ineligible to use the service in any form or manner (in whole or in part) due to this "Service Agreement", laws, regulatory requirements or the provisions of the jurisdiction applicable to the user (such as as defined in this Service Agreement).
(3) For the avoidance of doubt, residents residing in China and/or users settled in China are also included in the definition of "excluded persons".
We do not provide services to excluded persons. If you are an excluded person, please stop using our services immediately. If you continue to use our services, you acknowledge and agree that you will bear all corresponding responsibilities in accordance with the applicable laws, rules and regulations of the jurisdiction in which you live, and you shall hold us harmless Any liability arising therefrom, including but not limited to losses, third party claims or administrative penalties, and reasonable legal and administrative costs, fees and expenses, including reasonable attorneys' fees, incurred against us as a result of such breach, breach of contract, violation of the law.
4. Identity: Refers to the digital identity generated based on your public-private key pair.
5. Beginner's Guide: Refers to the Envo operation guide we provide you before you use Envo (and in the future), to help you understand the basics of the blockchain.
6. Creating or importing a wallet: refers to the process of using Envo to create or import a wallet after you accept this Service Agreement.
7. Wallet password: refers to the password you decide during the process of creating a Envo wallet, which will be used to encrypt and protect your private key. Envo is a decentralized application, and the wallet password is not stored on your mobile device or our server. Once you lose or forget the wallet password, you need to reset the wallet password with the help of a private key or mnemonic words.
8. Information prompt: For the information prompt content involved in the Envo software operation interface, it is recommended that you follow the relevant steps to operate.
9. Specific users: refers to users who must cooperate with us in fulfilling our obligation to disclose personal information in accordance with the laws, regulations and policies of Singapore and other countries.
10. Developer users: refers to users who use Envo open source code and developer mode and other services for developers in accordance with our notice and relevant open source agreements.
11. Private key: Consisting of 256 random characters, it is the core of digital tokens owned and used by users.
12. Public key: It is generated by one-way derivation of the private key with the help of cryptography principles, and is used to generate the blockchain digital wallet address, which is the public receiving address.
13. Mnemonic: It complies with the blockchain BIP39 industry standard and consists of 12 (or 15/18/21/24) ordered words generated by a random algorithm. It is an easy-to-record representation of the private key, which is convenient for you to back up and keep.
14.Keystore: It is a file in which the private key or mnemonic is encrypted and stored with the wallet password you set. It is only stored in your mobile device and will not be synchronized to our server.
15. Digital tokens: refers to the types of digital tokens currently supported by Envo, including but not limited to BTC, ETH, etc.
16. Materials: Refers to articles and other materials in the "Browse", "Market" and other sections on Envo. These materials are owned by third parties and cannot be reproduced without authorization. These materials are for your reference only and do not constitute our guidance or advice on your transactions.
17. Message center: refers to the inbox where you can receive information or notifications from us.
18. Personal information: refers to various information recorded electronically or in other ways that can identify the user's personal identity alone or in combination with other information, including but not limited to personal biometric information, email address, wallet address, mobile device information, and operation records , transaction records, etc., but does not include the user's wallet password, private key, mnemonic phrase, and Keystore.
19. Smart contract: refers to an Ethereum-based smart contract designed to disseminate, verify or execute contracts in an informatized manner, including but not limited to the Tokenlon smart contract mentioned later.
20. WETH: Refers to the tokenization of ether currency, because ether currency does not meet its own ERC20 standard, packaging ether currency tokenization to facilitate direct transactions between ether currency and other tokens. The conversion ratio of tokens supported by Envo to WETH is determined by a third-party smart contract.
21. ETH: refers to ether, which is an encrypted digital token related to the Ethereum blockchain. For the avoidance of doubt, it does not include "Ethereum Classic".
22. Envo open source code (“Envo OSC”): refers to part of the Envo software code that we publicly announced as open source, allowing developers and users to use (including secondary development) this part of the open source code in compliance with the relevant open source agreement and the provisions of our notice.
23. Open source agreement: refers to the third-party open source agreement that developers and users should follow when using Envo open source code.
24. Third-party services: refers to products and services provided by third parties such as third-party DApps, third-party smart contracts, third-party open source agreements, third-party hardware wallets, third-party web pages, and third-party exchanges.
3. Envo Services (collectively referred to as "Services")
1. Create and restore identities. You can use the "Create Identity" and "Restore Identity" buttons provided by Envo to create and restore identities, and manage multi-chain wallets under one identity at the same time.
2. Import wallet. For digital tokens supported by Envo, you can use Envo to generate a new wallet or import compatible wallets generated by other wallet tools in the relevant blockchain system.
3. Transfer and collection. You can use Envo's transfer and collection functions to manage digital tokens, that is, use the private key to electronically sign and modify the ledger of the relevant blockchain. Transfer means that the payer uses the payee's ENS domain name or blockchain address to perform a transfer operation. This "transfer" behavior involves the effective recording of the transaction in the distributed ledger of the relevant blockchain system (not on the Envo actual delivery or transfer of digital tokens).
4. Check the market. You can use Envo to view digital token exchange rates provided by third parties. Envo captures the corresponding digital token exchange rate information and displays it in the "Market" section of Envo.
5. Manage digital tokens. You can add, keep or remove digital tokens supported by Envo (except ETH and BTC) from the Envo interface.
6. Currency exchange (DEX). You can exchange digital tokens with a third party that uses a third-party Tokenlon smart contract, and Envo serves as an interface tool to help you interact with the third-party smart contract and display the corresponding results of the digital token exchange.
7. Browse DApps. You access and use the services provided by this DApp (including our own DApp and third-party DApp) through Envo.
8. Search for DApps. Through the search box on Envo, you can search for the DApps listed in Envo.
9. Integrated hardware wallet. You can use the appropriate version of Envo to match a specific hardware wallet and use the hardware wallet to confirm transactions made through Envo.
10. Password-free payment. You can use the password-free payment function in Envo. The password-free payment stores the user's wallet password in the Keychain/Keystore of your mobile device through a secure encryption algorithm, and calls your biometric (fingerprint or face) authentication during the transaction, quickly Complete payment and signature.
11. Developer mode. For the convenience of developers and users, in the developer mode, developers and users can enter the URL through the search box to access any other websites and third-party DApps that are not integrated in Envo.
12. Transaction records. We will copy all or part of your transaction records through the blockchain system. But you should refer to the latest transaction records of the blockchain system.
13. Suspension of Services. You know that based on the "irrevocable" nature of transactions in the blockchain system, we cannot withdraw or revoke the transaction for you, but under certain circumstances, we can suspend or restrict a user's operation of the Envo software.
14. Other services that we deem necessary to provide.
4. The user understands and accepts when using Envo:
1. Adhering to the decentralized characteristics of the blockchain, and in order to protect the security of your digital tokens, we provide decentralized services, which are greatly different from banking financial institutions. You understand and accept that we are not responsible for:
(1) Store your wallet password (that is, the password you set when you create/import the wallet), private key, mnemonic or Keystore;
(2) Retrieve your wallet password, private key, mnemonic or Keystore;
(3) Freeze the wallet;
(4) Report lost wallet;
(5) restore the wallet; or
(6) Transaction rollback.
2. You shall be solely responsible for keeping the mobile device containing Envo, backup Envo, backup wallet password, mnemonic phrase, private key and Keystore. If you lose your mobile device, delete and not back up Envo, delete and not back up your wallet, your wallet is stolen or you forget your wallet password, private key, mnemonic or Keystore, we cannot restore your wallet or retrieve your wallet password, private key, assistant Words or Keystore; if the user misuses the transaction (for example, enters the wrong transfer address, enters the wrong exchange amount), we cannot cancel the transaction, and we shall not be responsible for it.
3. If you use Envo's password-free payment function, please properly back up your wallet password. When your fingerprint or face recognition fails multiple times, you will need to enter your wallet password. If you forget your wallet password, you need to set a new wallet password by importing mnemonic words/private keys. We do not store your biometric information such as fingerprints and facial recognition, and we shall not be liable for this.
4. The digital token management services that Envo can provide do not include all existing digital tokens. Please do not operate any digital tokens that Envo does not support through Envo.
5. The DApps integrated on Envo include our own DApps and those provided by third-party platforms. For DApps provided by third-party platforms, Envo only provides search and blockchain browser functions for users to enter DApps, and does not provide any guarantee for the functions or service quality of third-party DApps. Before accepting services or conducting transactions on third-party DApps, you should judge and evaluate whether the services or transactions provided by the third-party DApps are risky.
6. The essence of the currency exchange function provided on Envo is that you use the third-party smart contract to exchange digital tokens on the blockchain system. For services provided by third-party smart contracts, Envo only provides you with tools to interact with third-party smart contracts, and does not provide any guarantees for the functions or service quality of third-party smart contracts. Before accepting services or conducting transactions on the third-party smart contract, you should judge and evaluate whether the service or transaction provided by the third-party smart contract is risky. We strongly recommend that you read the constantly updated user agreement and/or disclaimer for the relevant smart contract. We reserve the right to immediately terminate or suspend access to these third-party services for any reason without notice or liability.
7. The hardware wallet integrated on Envo is provided by a third party. Envo does not provide any guarantee for the function or service quality of the third-party hardware wallet, and Envo does not guarantee the matching function with any type and version of the hardware wallet (for details, please refer to notices from us from time to time shall prevail). Users should judge and evaluate whether the hardware wallet is risky before using the third-party hardware wallet. You should carefully read and agree to the continuously updated license agreement and other documents of the relevant hardware wallet.
8. If you use the developer mode on Envo to access other websites or third-party DApps that are not integrated in Envo by entering URLs, you acknowledge and agree that you are aware of the possible security risks of the websites and third-party DApps linked by the URL, and you will be solely responsible for them all risks and consequences.
4. Your rights and obligations
(1) Create or import a wallet
1. Create or import a wallet. You have the right to create and/or import a wallet through Envo on your mobile device, have the right to set the wallet password and other information of the wallet, and have the right to use your own wallet to transfer and receive money on the blockchain through the Envo application payments and other transactions.
2. Identity verification. According to the requirements of relevant laws and regulations, when using the relevant services provided by Envo, specific users should complete the relevant identity verification in a timely manner according to the prompts of Envo, and require you to submit information including but not limited to your name, ID number, mobile phone number, and bank card number and other personal information. Otherwise, the specific user will not be able to use the relevant services, and you will bear the losses caused by the delay of the specific user.
3. We may develop different software versions for different terminal devices, and you should choose to download and install the appropriate version according to your actual needs. If you obtain this software or an installation program with the same name as this software from a third party that is not legally authorized, we cannot guarantee whether the software can be used normally, nor can it guarantee its security, and the losses caused by it will be borne by you.
4. After the new version of this software is released, the old version of the software may not be available. We do not guarantee the security, continued availability and provision of corresponding customer service of the old software. Please check and download the latest version at any time.
(2) Using Envo
1. You shall be solely responsible for safekeeping information such as mobile devices, wallet passwords, private keys, mnemonic phrases, and Keystore. We are not responsible for keeping the above information for you. All risks, responsibilities, losses, and expenses arising from your loss of your mobile device or hardware wallet, active or passive disclosure, forgotten wallet password, private key, mnemonic, Keystore, or being attacked or scammed by others shall be borne by you.
2. Envo information prompt. You understand and agree to follow the information prompts we publish on Envo, and operate in accordance with the content of the information prompts, otherwise, all risks, responsibilities, losses, expenses, etc. arising therefrom shall be borne by you.
3. You know and understand that Envo is not obliged to perform due diligence obligations on third-party services, and you should carefully evaluate and bear all risks related to the use of Envo.
4. Provide information and documents. If we consider it necessary to obtain user-related information to comply with any applicable laws or regulations related to the use or operation of Envo, you should provide us with such information in a timely manner as required by us, and you understand and accept that we may Restrict, suspend or terminate your use of Envo until you provide the information we require. You undertake to inform us in a timely manner of any changes in the documents and information it provides to us pursuant to this Service Agreement, and we have the right to consider the documents and information provided by you to The content of the information is true, correct, not misleading and unchanged.
5. Complete identity verification. When we reasonably believe that your transaction behavior or transaction situation is abnormal, or that your identity information is suspicious, or we think that you should check your identity card or other necessary documents, please actively cooperate with us to check your valid identity card or other necessary documents, and complete relevant identity verification in a timely manner.
6. Transfer money.
(1) You know that the daily transfer limit and number of transactions you can use in the Envo service may be due to the country/region where you use the transfer service, regulatory requirements, transfer purpose, Envo risk control, identity verification, etc. rather different.
(2) You understand that based on the "irrevocable" attribute of blockchain operations, when you use the Envo transfer function, you should bear the consequences caused by your operational errors (including but not limited to your wrong transfer address, your The problem of choosing the transfer node server by itself).
(3) You understand that when using the Envo service, the following situations may lead to the unavailability of the transfer function, "transaction failure" or "package timeout" of the transfer:
a) Insufficient wallet balance;
b) Insufficient transaction miner fees;
c) The block chain fails to execute the smart contract code;
d) exceeding the payment limit stipulated by the regulatory authority, Envo or laws and regulations;
e) Technical failures such as networks and equipment;
f) The transaction is abandoned due to block chain network congestion, failure and other reasons;
g) Your address or the counterparty's address is identified as a special address, such as a high-risk address.
(4) You understand that Envo only provides you with a transfer tool. After you use Envo to complete the transfer, we have completed all the obligations of the service, and we do not assume any responsibility for other related disputes.
7. Currency exchange. As you know, the daily limit for currency exchange is currently limited by a third-party smart contract. We may also limit your daily currency conversion amount and adjust it from time to time.
8. Legal compliance. You understand that when Envo is operating or using DApps and smart contracts on Envo for transactions, you should follow the requirements of relevant laws, regulations and national policies.
9. Announcement notification. Envo will send you notifications in the form of website announcements, message center information, pop-up prompts or client notifications, such as notifying you of transaction progress, or prompting you to perform relevant operations, please pay attention in time.
10. Service fees and tax obligations:
(1) When you use Envo's currency exchange service, the third-party smart contract will charge you a handling fee and/or service fee. The specific fee is subject to the amount charged by the third-party smart contract, and the Envo information prompt is for reference only;
(2) We will not charge you any form of service fee or handling fee for the time being, and we will separately agree or publish rules when we need to charge for certain services in the future;
(3) When you use Envo to transfer funds, you should pay "miner's fee" or network fee, the amount is determined by you and charged by the relevant blockchain network;
(4) You understand that under certain circumstances (including but not limited to insufficient "miner's fee" or network fee you paid for the transfer during the transfer, or the instability of the relevant blockchain network), your transfer operation may fail; In such cases, even if your transfer operation is not completed, you will be charged a miner's fee by the relevant blockchain network;
(5) You are responsible for paying all the tax liabilities and other expenses incurred by you due to the transaction on Envo.
(3) Development of developers and users based on Envo open source code
1. Developers and users have the right to use the Envo open source code we announced on official channels for secondary development of applications, and to download and use any patches or vulnerability solutions we released for the Envo open source code.
2. When using Envo open source code, developers and users understand and agree that:
(1) If developers and users find any loopholes, defects or software improvement solutions in the process of using Envo open source code, they should contact us in time and inform us, and stop any harmful use behavior (if applicable);
(2) The Envo open source code may contain third-party open source agreements and source codes. We do not provide any form of guarantee for the functions, virus-free, and bug-free of such third-party open source agreements and source codes. Developers and users should make their own judgments and evaluate the consequences of using Envo open source code. Developers and users should carefully read and follow the relevant open source software agreements and the requirements of our notices from time to time.
5. Risk Warning
1. You understand and are aware that due to the lack of sound laws, regulations and policies in the field of digital tokens, digital tokens in this field may have major risks such as failure to cash and technical instability. You also understand that the price volatility of digital tokens is much higher than that of other financial assets. We cautiously remind you that you should choose to hold or dispose of any digital token in a reasonable manner according to your own financial situation and risk preference. You also understand that the market viewing function provided by Envo is only a search result of grabbing the digital token exchange rate information of some exchanges, and does not represent the latest market price or the best quotation.
2. When using Envo services, if you or your counterparty fail to comply with this "Service Agreement" or relevant website instructions, transaction and payment pages, we do not guarantee that the transaction will be completed smoothly, and we do not Liability for damages. If the above situation occurs, and the money has been credited to your or your counterparty's Envo wallet or third-party wallet first, you understand that the blockchain operation has the "irreversible" attribute, and the relevant transaction has the "irreversible" feature, by You and your counterparty shall bear corresponding risks and consequences by themselves.
3. You understand and are aware that all currency exchange transactions occur, proceed and complete on third-party smart contracts. Envo is only used as an interface tool to help you interact with third-party smart contracts and display the corresponding results of the completed transaction.
4. When you use third-party services through Envo, we strongly recommend that you carefully read the service agreements, privacy policies, and other relevant documents and information of such third-party services to understand the transaction objects and product information, and carefully evaluate the risks before conduct transactions on that third party. You understand that this transactional and binding contractual relationship is established between you and your counterparty and not with us. We are not responsible for all risks, responsibilities, losses, and expenses arising from your trading behavior.
5. When you transfer digital tokens to other wallet addresses, you should judge whether the other party is a person with full civil capacity during the transaction and decide whether to trade with the other party or transfer money to the other party.
6. During the transfer process, if there are similar abnormal information prompts such as "transaction failure" and "packaging timeout", you should reconfirm through the official channel of the relevant blockchain system or other blockchain query tools to ensure Avoid repeated transfers; otherwise, all losses and expenses arising therefrom shall be borne by you.
7. You understand that after you create or import a wallet on Envo, your Keystore, private key, seed phrase and other information will only be stored on the current mobile device, not on Envo or our servers. You can follow the operation guide provided by Envo to replace the mobile device by synchronizing the wallet and other methods. However, if you have not saved or backed up your wallet password, private key, mnemonic phrase, Keystore and other information and your mobile device is lost, your digital tokens will be lost and we cannot retrieve them for you. If you export, save or back up your wallet password, private key, mnemonic, Keystore and other information, or if the device or server that saves or backs up the above information is hacked or controlled, your digital tokens will be lost It is therefore lost and we cannot retrieve it for you. Any and all losses arising from the foregoing shall be borne by you.
8. We recommend that you make a safe backup of your wallet's wallet password, private key, mnemonic, Keystore and other information when creating or importing a wallet. We draw your attention, please do not use the following electronic backup methods: screenshots, emails, notepad applications in mobile phones, SMS, WeChat, QQ and other electronic backup methods. We recommend that you copy information such as mnemonic phrase and Keystore on a paper notepad, and you can also keep electronic data in a password manager.
9. We recommend that you should:
(1) Confirm whether the hardware wallet you purchased matches the version of Envo; and
(2) Purchase a brand new hardware wallet from official channels.
10. We kindly remind you to use Envo's password-free payment function with caution, and suggest that you should:
(1) Carefully understand the security level of your mobile device biometrics;
(2) Do not enable the password-free payment function in public mobile phones; and
(3) If the digital assets in the wallet are large, please do not enable the password-free payment function.
11. We recommend that you use Envo in a safe network environment to ensure that your mobile device is not jailbroken or rooted to avoid possible security risks.
12. Please be vigilant against fraud when using Envo. Once you notice any suspicious behavior, we encourage you to let us know immediately.
6. Service change, interruption and termination
1. You understand and agree that we may temporarily provide some service functions at our sole discretion, or suspend some service functions or open new service functions in the future. When we change the service, as long as you still use Envo, you still agree to this "Service Agreement" or the amended terms of this "Service Agreement".
2. In order to avoid any misuse of Envo or any security risk of digital tokens as much as possible, you should avoid using Envo without basic knowledge of blockchain. For users who do not have the basic knowledge of blockchain, we have the right to refuse to provide some or all of the service functions.
3. You understand that we will suspend the provision of services (or completely terminate the services when the following situations occur):
(1) Suspension of Envo's operations due to technical reasons such as equipment, blockchain system maintenance, upgrades, failures, and communication interruptions;
(2) Due to force majeure factors such as typhoons, earthquakes, tsunamis, floods, power outages, wars or terrorist attacks, computer viruses, Trojan horses, hacker attacks, system instability or government actions, we cannot provide services or we reasonably believe that we will continue to provide services The service will have a greater risk;
(3) Material adverse changes in applicable laws or policies; or
(4) Other circumstances beyond our control or reasonably foreseeable occur.
4. We may unilaterally suspend or terminate your use of some or all functions of Envo when the following situations occur to the user:
(1) User's death;
(2) Stealing other people's wallet information or mobile devices;
(3) Fill in false personal information in Envo;
(4) Refuse Envo's mandatory update operation;
(5) Use Envo open source code in violation of third-party open source agreements or our notices;
(6) Use Envo for illegal or criminal activities;
(7) Prevent other users from using Envo normally;
(8) Pretending to be our staff or managers;
(9) Attack, intrude, alter or otherwise threaten the normal operation of our computer systems;
(10) Use Envo to promote spam advertisements;
(11) spreading rumors that damage our and Envo's goodwill; or
(12) Illegal acts, other acts that violate this "Service Agreement", and circumstances where we reasonably believe that the function should be suspended.
5. If we change, interrupt or terminate the service, you have the right to export your wallet and other information within a reasonable time.
7. Your representations and warranties
1. You shall abide by the laws and regulations of the country or region where you live, and shall not use Envo for any illegal purpose, nor use Envo in any illegal way.
2. You are not an excluded person who is not eligible to use Envo services.
3. You shall not use Envo to engage in any illegal or criminal acts, including but not limited to:
(1) Endangering the national security of the country or region where you live, leaking state secrets, subverting state power, or undermining national unity;
(2) Engage in any illegal and criminal activities, including but not limited to money laundering, illegal fund-raising, etc.;
(3) By using any automated programs, software, engines, web crawlers, web analysis tools, data mining tools or similar tools to access our services, collect or process the content we provide, intervene or attempt to intervene with any user;
(4) Provide gambling information or induce others to participate in gambling in any way;
(5) Invading other people's Envo wallets to steal digital tokens;
(6) Carry out transactions that are inconsistent with the content of the transactions claimed by the counterparty, or transactions that are not true;
(7) Engage in any behavior that infringes or may infringe Envo service systems and data;
(8) Other actions that we have legitimate reasons to consider inappropriate.
4. You understand and agree that you will be responsible for your violations of relevant laws (including but not limited to customs and/or taxation regulations) or the provisions of this "Service Agreement", and should be responsible for such violations, breaches of contracts, illegal and indemnify us against any loss, third-party claim or administrative penalty, including reasonable legal and administrative costs, fees and expenses, and reasonable attorneys' fees.
5. You promise to pay our service fees (if any) on time, otherwise we have the right to suspend the services provided to you.
8. Privacy Policy
Any data or information you provide to us is also subject to our privacy policy (“Envo Privacy Policy”), which is also a part of this Service Agreement.
9. Disclaimer and Limitation of Liability
1. We are only responsible for the obligations listed in this "Service Agreement".
2. You understand and agree that, to the maximum extent permitted by law, we can only provide Envo services in accordance with the existing technical level and conditions. We are not responsible for Envo's inability to provide services due to any of the following reasons:
(1) Envo system shut down for maintenance or upgrade;
(2) Due to force majeure such as typhoons, earthquakes, floods, lightning or terrorist attacks;
(3) Your mobile device hardware and software, communication lines, and power supply lines fail;
(4) You use our services improperly or in ways that are not authorized or approved by us;
(5) Due to computer viruses, Trojan horses, malicious program attacks, network congestion, system instability, system or equipment failures, communication failures, power failures, bank or government actions, etc.;
(6) Any other reasons not caused by us.
3. We shall not be liable for any of the following situations:
(1) The user’s digital tokens are lost due to your loss of mobile device, deletion and failure to back up Envo, deletion and failure to back up wallet, forgetting and failure to back up wallet password, private key, mnemonic, and Keystore;
(2) Because you disclose your wallet password, private key, mnemonic phrase, Keystore, or borrow, transfer or authorize others to use your own mobile device or Envo wallet, or you did not download the Envo application through our official channels or otherwise insecure The loss of your digital tokens caused by using the Envo application in a certain way;
(3) Loss of digital tokens caused by your misoperation (including but not limited to your wrong transfer address, your choice of transfer node server) Envo;
(4) The loss of your digital tokens caused by misoperation due to your ignorance of blockchain technology;
(5) Due to system lag, blockchain system instability and other reasons, the transaction records of our copied users on the blockchain are deviated;
4. You shall bear the risks and consequences arising from or related to the following situations:
(1) Transactions performed by you using third-party services;
(2) You use developer mode; and
(3) When you use currency exchange services, such risks and consequences shall be borne by you, the counterparty to the transaction and the relevant smart contract issuer.
5. You understand that Envo is only used as a tool for your digital token management. We cannot control the quality, safety or legality of third-party services, the authenticity or accuracy of information, and the ability of the counterparty to perform its obligations under the agreement signed with you. Use of third-party services is at your own discretion. You understand that this transactional and binding contractual relationship is established between you and your counterparty and not with us. We remind you that before using third-party services, you should carefully judge the authenticity, legality and validity of the relevant information provided by third-party services. In addition, your dealings with any third parties are entirely at your own risk.
6. You are aware that Envo may provide services to you and your counterparty at the same time or have an affiliated relationship or other interest-related relationship, and you agree to expressly exempt us from any actual or potential conflicts of interest that may exist in such actions , and shall not be used to assert that we have a legal defect in the provision of the Services, nor to increase our responsibility or duty of care.
7. We do not provide the following forms of guarantee:
(1) The services we provide will meet all your needs;
(2) Any technologies, products, services, information or other materials you obtain through our services will meet your expectations;
(3) The timeliness, accuracy, completeness, and reliability of information such as the digital token market transaction prices that we capture from third-party exchanges;
(4) Your counterparty on Envo will perform its obligations in the transaction agreement with you in a timely manner.
8. In any case, our total liability for breach of contract under this "Service Agreement" shall not exceed 1) the market value of 0.1 ETH; or 2) SGD 100, whichever is higher.
9. You understand that Envo is only used as a tool for you to manage digital tokens and display transaction information, and we do not provide legal, tax or investment advice and other services. You should seek advice from legal, taxation, and investment professionals on your own, and we are not responsible for any investment losses, data losses, etc. that you suffer during the use of our services.
10. You understand that in accordance with the requirements of applicable laws and regulations, we may change our user access standards from time to time, and limit the scope and methods of providing services to specific users, etc.
10. Other Terms
1. Not transferable. Subject to the terms of this Service Agreement, only you, and not others, have the right to assert claims against us related to your use of the Services. You may not assign, trade, or attempt to transfer, trade, your rights to this claim. Any such assignment is void and we shall have no obligation or liability to the assignee.
2. Intellectual property rights. Envo is an application developed and owned by us. The intellectual property rights of any content displayed on Envo (including this "Service Agreement", announcements, articles, videos, audios, pictures, files, information, materials, trademarks or logos) are owned by us or third-party obligees. You may use the Envo App and its content solely for the purpose of holding and managing Digital Tokens. Without the prior written consent of us or the third-party rights holder (or the permission of the relevant open source agreement), no one may use, modify, decompile, reproduce, publicly disseminate, change, distribute, distribute or publicly publish the above applications and Content (including Envo open source code). This "Service Agreement" shall not be deemed to grant you any intellectual property rights, including the right to use any information, pictures, user interfaces, logos, trademarks, business names, network domain names or copyrights related to us or the Services for any purpose.
3. No Waiver. Any failure by us to enforce this Service Agreement or to assert to you our rights, claims or causes of action under this Service Agreement shall not be deemed a waiver of any rights, claims or causes of action we have against you right.
4. Complete agreement:
(1) This "Service Agreement" is composed of the "Envo Service Agreement", "Envo Privacy Policy" and various rules we publish from time to time (including the content of the "Help Center").
(2) In addition to the "Envo Service Agreement" and "Envo Privacy Policy" in this "Service Agreement", this "Service Agreement" contains all agreements and understandings between us regarding the use of Envo and related services, and replaces all previous An agreement, understanding, or arrangement (oral and written).
5. Taxes:
(1) The use of the services under this "Service Agreement" does not include taxes applicable to, arising from, or related to your use of the services in any jurisdiction ("taxes payable").
(2) You shall be responsible for ascertaining any tax liability and for declaring, withholding, collecting, reporting and remitting the correct tax liability to the appropriate tax authority. You are solely responsible for all penalties, claims, fines, penalties and other liabilities arising from failure to complete or perform any of your tax-related obligations.
(3) We are not responsible for determining any tax liability and are not responsible for declaring, withholding, collecting, reporting and remitting the correct tax liability to the appropriate tax authority.
6. Applicable law. This Service Agreement shall be governed by the laws of the Republic of Singapore and shall be interpreted accordingly.
7. Jurisdiction. For any dispute arising out of or in connection with this Service Agreement (including any issues concerning its existence, validity, and termination), the parties shall first seek a settlement. If the dispute remains unresolved within thirty (30) days of the commencement of the settlement process, the parties shall submit the dispute to the Singapore International Arbitration Center ("SIAC"), and resolve the dispute by following the then-effective arbitration rules of the Singapore International Arbitration Center. (the Rules are deemed to be incorporated by reference into these Terms), and finally resolved by arbitration in Singapore. The arbitral tribunal shall consist of one arbitrator appointed by the chairman of SIAC. The language of the arbitration shall be English. Each party irrevocably submits to the non-exclusive jurisdiction of the Singapore courts to support and assist the arbitration proceedings pursuant to the foregoing of this paragraph, including granting interim relief, if necessary, pending the outcome of such proceedings.
8. The Contracts (Rights of Third Parties) Act. The Contracts (Rights of Third Parties) Act (Cap. 53B) of the Republic of Singapore (as may be amended, amended or supplemented from time to time) shall apply to this Service Agreement. Persons who are not a party to this "Service Agreement" shall not have any rights under this "Service Agreement", nor shall they have the right to enforce this "Service Agreement".
9. Independence. If any part of this Service Agreement is held to be invalid, illegal or unenforceable by any legislation governing this Service Agreement, it will be held to be invalid, illegal or unenforceable only to that extent (and without further extension). For the avoidance of doubt, the remainder of this Service Agreement will survive and remain in full force and effect.
10. Partial void. The determination of any provision of this Service Agreement to be illegal, invalid or unenforceable under the laws of any jurisdiction shall not affect the determination of such provision as legal, valid or enforceable under the laws of other jurisdictions, nor shall it affect The legality, validity or enforceability of other provisions of this "Service Agreement".
11. The translation of this "Service Agreement". Any translations (if any) of this Service Agreement are provided for your convenience only and are not intended to modify the English version of this Service Agreement. If there is a conflict between the English and non-English versions of this Service Agreement, the English version shall prevail.
Eleven, other
1. You should fully understand and abide by all relevant laws, regulations and rules of your jurisdiction and the use of services.
2. If you encounter any problems during the use of the service, you can contact us by submitting feedback on Envo.
3. All users can view this "Service Agreement" in Envo. We encourage you to review this Service Agreement each time you visit Envo.
4. For matters not covered in this "Service Agreement", you must abide by the announcements and related rules that we update from time to time.
5. This "Service Agreement" will take effect on October 14, 2022.
